We will accept the return or exchange of any item that is in perfect condition, undamaged, functional, resalable and returned in its original packaging. It will be possible to replace the item or request a refund of the cost of the product, from which transport costs will be deducted, which are to be considered non-refundable. The return or replacement procedure must take place within 14 days from the date of receipt of the goods.
Purchases made on our site, like all remote purchases by telephone, fax or correspondence, since they take place outside commercial premises, are protected by Legislative Decree No. 185 of 22 May 1999, which provides for the possibility for the consumer to exercise the right of withdrawal.
The consumer can exercise the right of withdrawal (excluding shipping costs), without any penalty and without specifying the reason, within and no later than 14 days from the day of receipt of the goods. The right of withdrawal consists in the right to return the purchased products to the seller and consequently obtain reimbursement of the purchase price of the products themselves (in compliance with the provisions of article 64 of Legislative Decree 6 September 2005 n. 206 and subsequent amendments and additions art. 52, paragraph 1 and 2, of Legislative Decree 21 February 2014 n. 21 art. 47, paragraph 2 and European directive 211/83/EU).
Definitions:
Professional buyer: company, natural or legal person who purchases goods for purposes related to the business activity carried out.
Consumer buyer: natural person who purchases goods for purposes unrelated to any business activity carried out.
Coccole&Ricami will have the right to withdraw from the contract in whole or in part by means of written communication to be sent to the Purchaser by e-mail. The Purchaser will not be entitled to receive any compensation for any damages deriving from the withdrawal of Coccole&Ricami.
The buyer-consumer has the right to withdraw from the contract with Coccole&Ricami, without any penalty and without specifying the reason, within 14 days of receiving the goods.
The professional Buyer cannot exercise the right of withdrawal.
The parties agree that the indication in the order of a VAT number in the order form, or in the registration of personal information, of a VAT number qualifies the buyer as a professional.
- Procedure for exercising the right of withdrawal by the Purchaser -
The right of withdrawal is exercised by sending, within the aforementioned term of 14 days, a written communication to Coccole&Ricami by registered letter with acknowledgment of receipt. for this purpose, e-mail or fax can be used, provided that the communication is confirmed by registered letter with acknowledgment of receipt within the following 48 hours. The registered letter is considered sent in good time if delivered to the accepting post office within 14 days of delivery of the goods.
Following written communication from the Purchaser (registered mail with acknowledgment of receipt), Coccole&Ricami will send confirmation of the withdrawal by email to the address indicated in the order.
- Execution of the right of withdrawal by the Purchaser -
The right of withdrawal will be deemed exercised regularly and correctly by the Purchaser only and exclusively if carried out in compliance with the aforementioned deadline and the communication method described.
Upon receipt of the notice of withdrawal, the parties are released from their respective obligations deriving from the purchase order. If the products have been delivered, the consumer is required to return them within 14 days from the date of receipt of the goods. For the purposes of expiry of the term, the goods are considered returned when they are delivered to the accepting post office or to the shipper.
- Return of the goods subject to the right of withdrawal by the Purchaser -
Following the shipment of the ordered products, the only costs payable by the consumer for exercising the right of withdrawal are the direct costs of shipping and returning the goods to the sender and any storage costs (for non-collection after 10 days), also in case of cancellation of the order in progress already shipped or refusal of the package upon delivery by the courier or for failure to collect the products in storage at the courier's warehouse after 10 days. It is recommended to take care of the packaging in order to avoid damage in the return transport and to apply relative insurance for the shipment. Coccole&Ricami is not liable for any damage or loss of goods returned without insurance.
The goods must be returned perfectly intact to the Coccole&Ricami headquarters in Via Onofrio Graziano 26 - 90040 Capaci (PA) Italy.
- Reimbursement method -
In case of withdrawal exercised by Coccole&Ricami and in case of payment already received, Coccole&Ricami will refund the same. To this end, at the request of Coccole&Ricami, the Purchaser must indicate his Bank, Paypal or Postepay details.
In case of withdrawal exercised by the Purchaser, Coccole&Ricami will refund the amount paid by the same, by credit with Paypal, Postepay or Bank Transfer. To this end, the Purchaser must indicate his Bank, Paypal or Postepay details in the written communication of the right of withdrawal.
If the right of withdrawal is exercised by the consumer correctly, Coccole&Ricami will refund the value of the goods previously purchased. The refund is made free of charge, in the shortest possible time and in any case within 30 days from the date on which Coccole&Ricami became aware of the consumer's exercise of the right of withdrawal. The sums are understood to be reimbursed within the terms if they are actually returned, sent or re-credited with a value no later than the expiry of the previously indicated term.
- Necessary conditions for the execution of the right of withdrawal -
The right of withdrawal is in any case subject to the following conditions:
The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product.
The purchased good must be intact and returned in the original packaging, complete in all its parts.
Furthermore, the right of withdrawal does not apply to products created, coloured, modified, packaged or personalized at the request of the Purchaser.
In accordance with the law, the shipping and packing costs for returning the product are the responsibility of the Purchaser. The goods travel at the Purchaser's expense and risk until they return to the Coccole&Ricami warehouses. Coccole&Ricami recommends insured shipping. Coccole&Ricami is not responsible for delays, loss, theft and/or damage caused by means of shipping.
In case of delays, losses, thefts and/or damages caused by means of shipment, the right of withdrawal cannot be exercised. Coccole&Ricami will notify the customer of the incident (within 5 working days of receipt of the goods in its warehouses or of the communication of anomaly by the carrier). The Purchaser will thus be able to file a timely complaint against the carrier of his choice and obtain a refund from them for what happened; in this case, the product will be made available to the customer for its return, together with the cancellation of the request for withdrawal.
When the goods return to the warehouse, they will be examined to assess the integrity of the original packaging and its completeness, as well as any damage or tampering made to the goods themselves. If the original package and/or packaging are not intact or incomplete, or the goods are damaged or tampered with, Coccole&Ricami reserves the right to withhold the costs necessary for restoring or replacing them.
In compliance with the art. 5, paragraph 6, Legislative Decree n. 185 dated 22/05/1999, within 30 days of receipt of the perfectly intact goods, Coccole&ricami will refund the Customer in full for the value of the products purchased and not for the ancillary costs of return shipping which remain the responsibility of the customer.
The right of withdrawal applies only to material goods purchased and excludes the ancillary costs of the shipping service that the customer uses for both the outward and return journeys.
The present General Conditions of Sale apply to all supplies of goods, regulate the commercial relationship between Coccole&Ricami and the Customers and are accepted with the validation of the order.
Coccole&Ricami and Customers are required to undertake to comply with these General Conditions of Sale.
- Jurisdiction -
For any dispute, the Court competent to decide the validity, interpretation and execution of these General Conditions of Sale will be that of the Court of Palermo.
